Job Summary:

The primary duty of a clerk of court is to monitor all criminal cases and perform a variety of difficult, complex, and confidential duties that ensure the effective administrative of justice.  The clerk of court also oversees the criminal court operations and functions; serves as courtroom clerk; prepares and processes necessary materials and documents and provides information regarding court programs, policies, and procedures.

Duties and Responsibilities:

  • First and foremost upholding the laws of the Turtle Mountain Tribal members by adhering to the Tribal Code, Constitution, Court Rules, Court Procedures and the Clerk’s Code of Conduct, and Adhering to and maintaining to the Oath of Confidentiality for all information at all times on/off the job.
  • Acknowledging and adhering to the internal Chain of Command including but not limited to any and all requirements under the Personnel Policy and Procedures Manual.
  • Maintaining the integrity and professionalism of the Court by conducting themselves in a manner becoming of an officer of this Court.
  • Serves as a knowledgeable resource for information regarding Court policies, procedures, objectives, and operational functions in the assigned area;
  • Responds to inquiries in person and by telephone by providing information utilizing judgment, knowledge, and interpretation and refers those making inquiries to appropriate source(s) as necessary;
  • Receives, compiles, and organizes information for the preparation of documents, records, reports, and correspondence as assigned;
  • Composes confidential correspondence, documents, and reports;
  • Physically files various pleadings, depositions, exhibits, and other documents in open Court;
  • Prepares, enters, serves, and processes judgments, orders, findings and recommendations, decrees, and warrants;
  • Processes and delivers bond information and forfeitures;
  • Performs a full range of legal clerical work in processing cases before the Court;
  • Maintains electronic or physical court docket and permanent files;
  • Types and prepares a variety of documents for the Court including minutes of court hearings, trials, and proceedings;
  • Records and maintains a permanent minute record of Court proceedings and hearings; enters dispositions of hearings;
  • May collect, prepare, mark, and maintain exhibits for the Court;
  • Prepares court calendar; may calendar all Court events; coordinates with other departments to adjust schedule to verify accuracy of hearing schedule and department; notifies interested parties of changes in the calendar;
  • Pulls and reviews electronic or physical case files prior to hearings; verifies that electronic or physical files are complete; prepares electronic or physical files for Court proceedings including preparing sheets for each file and checking files for appropriate documents/pleadings and settings;
  • Delivers physical files to appropriate personnel;
  • May assist in the jury selection process;
  • Performs case data entry on a daily basis; performs case maintenance for statistical reporting purposes; compiles data from hearings, continuances, and other scheduled events;
  • Must become CJIS/NCIC certified to accurately compile and enter data into system.
  • Accurately filing, scheduling, recording and docketing legal transactions in the Criminal Department that consist of complaints, warrants, and extraditions.
  • Scheduling cases and furnishing appropriate notices to relevant parties pursuant to applicable Code sections and policies for all criminal arraignments, jury trials, judge trials, and pre-trials.
  • Work closely with the Tribal Prosecutor, Public Defender, Probation, and Corrections.
  • Collect and log all bonds received and returned.
  • Assisting with switchboard duties as needed.
  • Must properly receipt incoming fines, fees and bonds, through the Tribal Court Database; must report any mistakes made to the Tribal Court Database to the proper supervisor for recording and correction.
  • Required to be cross-trained in all divisions and will be required to substitute for absent clerk as needed.
  • May require work beyond regular business hours.
  • Performs administrative support duties for a judge; setting cases for hearings and setting appointments with the judges.
  • Must do background checks daily.
  • Other job related duties as assigned by supervisor.

Qualifications:

  • Must possess a two (2) year related degree with administrative support experience.
  • Must pass a Federal, State and Tribal background check.
  • A high level of personal integrity, professionalism and a firm belief in upholding the oath of confidentiality.
  • Familiarity with various forms of computer software including Microsoft Word, Outlook Express, Microsoft Outlook, Microsoft Access and Microsoft Excel.
  • Interpersonal communication skills.
  • Must be able to attend local and out-of-state training as directed by Supervisor.
  • Ability to multi-task and manage on-the-job stress in a professional manner.
  • Must submit to and pass drug testing prior to starting and continue with random testing throughout employment.
  • A clean criminal background check and no prior record is mandatory.
