SUMMARY:

 As a court-appointed advocate, the guardian ad litem will act on behalf of minor children in the Tribal court system, specifically in cases of neglect and abuse. The Guardians ad litem will be appointed by Tribal Court to advocate for the best interest of a child involved in the court system. The guardian ad litem solely represents the child’s interests.

The guardian ad litem is subject to all the rules of Tribal court and shall receive all pleadings, notices, discovery, correspondence relating to the child, orders and notices of appeal.

 DUTIES AND RESPONSIBILITIES:

  • Provides an objective examination of the child’s situation to assist the court in understanding the child’s true circumstances and needs,
  • Provides effective, independent advocacy in the best interest of children before the Tribal Court
  • Advocates for the child’s best interest in all court proceedings
  • Investigates and collects information that helps develop recommendations for the court.
  • Knowledge of child development and the issues and dynamics that surround juvenile cases such as child abuse, domestic abuse and chemical dependency.
  • Reviews records from schools, social services, doctors and hospitals, psychologists, law enforcement and the courts
  • Observes and documents how the child interacts with each parent separately Facilitates communication and shares information between all participants, including
  • Tribal Court, lawyers, social services, parents and other involved professionals.
  • Ensures the child understands the various court proceedings (dependent upon age)
  • Monitors the entire court process and attends all court proceedings
  • Ensures that all relevant information is received and shared with the proper parties.
  • Must have experience with interviewing and assessment skills
  • Determine if a permanent plan has been created and ensure required services are being provided
  • Maintains complete records: appointments, interviews, collateral information gathered and that the records are kept confidential
  • Participates in planning and strategy sessions
  • Provide reports, preferably written, of findings and recommendations to the court at each hearing to ensure that all the relevant facts are before the court.
  • Performs all phases of a case pursuant to the Turtle Mountain Tribe Law & Order Code under the Children’s Code within the jurisdiction of the Turtle Mountain Tribal Court
  • Other related job duties as assign by Director.

QUALIFICATIONS:

  • Must possess a minimum of a two-year degree (A.A. or A.S.) or a four-year degree from an accredited university/college preferred.
  • Must possess a ND Driver’s license and proof of insurance
  • Benefits: Comprehensive benefits include paid vacation/holiday/sick leave, and worker’s compensation
  • Must be well-versed in Tribal law
  • Must be familiar with community resources on the Turtle Mountain Reservation
  • Must complete initial training course and all trainings required
  • Must participate in planning/training as provided by OVC Technical Assistance
  • Must be willing to abide by written code of ethics
